THAILAND – New rules on submission of Working regulation via Electronic Media

Any employer who has 10 or more employees must adopt a working regulation and submit its copy and any further revised version to the relevant Labor Office. A Copy of the working regulation must be also kept and posted at the employer’s premises.

The Labor Protection Act has been recently amended in order to enable employers to submit the copy of working regulation via mail, fax or electronic media, with the purpose of declaring the rights and obligations between employer and employees as mutual practice. The employer must apply for an user’s ID and password through the official website of the Department of Labor Protection and Welfare in order to submit its working regulation via electronic media.

Once the employer submits a copy of its working regulation, it shall be deemed that the employer complies automatically with Labor Law. Should any part of the working regulation do not comply with Labor Law, the Labor Office shall have authority to order the employer to correct its working regulation.
